    2. Our Services

    Koncept Digital provides digital marketing services specifically tailored to the medical and healthcare sector, including but not limited to:
    • Search Engine Optimisation (SEO)
    • Pay-Per-Click (PPC) advertising management
    • Social media marketing and management
    • Website design and development
    All services are provided on a monthly retainer basis unless otherwise agreed in writing. Specific deliverables, timelines, and fees will be detailed in a separate service agreement or proposal.

    3. Use of Our Website

    You may use our website for lawful purposes only. You must not:
    Use the website in any way that breaches any applicable local, national, or international law or regulation
    Attempt to gain unauthorised access to our website, servers, or databases
    Introduce viruses, trojans, worms, or other malicious software
    Reproduce, duplicate, copy, or resell any part of our website without our express written permission
    Use automated systems or software to extract data from our website (scraping)

    4. Intellectual Property

    Upon full payment for services rendered, clients shall own the deliverables specifically created for them as outlined in the relevant service agreement, unless otherwise stated.

    5. Client Obligations

    When engaging our services, you agree to:
    Provide accurate, complete, and timely information necessary for us to deliver our services
    Ensure all content and materials you provide to us do not infringe any third-party rights
    Comply with all applicable laws and regulations, including those specific to healthcare advertising (e.g., ASA CAP Code, CQC regulations)
    Pay all fees in accordance with the agreed payment terms
    Provide timely feedback and approvals to prevent delays in service delivery

    6. Fees and Payment

    Fees for our services will be set out in the relevant service agreement or proposal. Unless otherwise stated:
    • All fees are quoted in GBP and are exclusive of VAT (where applicable)
    • Invoices are issued monthly and are payable within 14 days of the invoice date
    • Late payments may incur interest at the rate of 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998
    • We reserve the right to suspend services if payment is not received within 30 days of the due date

    7. Termination

    Either party may terminate the service agreement by providing 30 days’ written notice, unless a different notice period is specified in the service agreement.
    We may terminate or suspend services immediately if:
    • You breach any material term of these Terms or the service agreement
    • You fail to pay fees when due
    • You become insolvent or enter administration
    Upon termination, you remain liable for all fees accrued up to the date of termination.

    8. Limitation of Liability

    To the fullest extent permitted by law:
    • Our total liability arising out of or in connection with these Terms or our services shall not exceed the total fees paid by you in the 12 months preceding the claim
    • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities
    • We do not guarantee specific results from our digital marketing services, as outcomes depend on numerous factors beyond our control
    Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

    9. Disclaimers

    The information provided on our website is for general information purposes only. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or suitability of the information.

    Any reliance you place on such information is strictly at your own risk. We are not responsible for the content of external websites linked from our site.

    10. Confidentiality

    Both parties agree to keep confidential any proprietary or sensitive information received from the other party during the course of the engagement. This obligation survives the termination of the service agreement for a period of 2 years.

    11. Force Majeure

    Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, pandemics, government actions, or failures of third-party services.

    12. Governing Law and Jurisdiction

    These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

    13. Changes to These Terms

    We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
